Mediation

Mediation for sectional title and HOA disputes

Not every dispute in a community scheme should end in litigation. Mediation lets owners, trustees and managing agents reach a workable, enforceable outcome sooner and at lower cost.

Our accredited mediator, Andrea Greyling, combines mediation expertise with practical legal experience in debt recovery, defended matters and deceased estates, so agreements are structured to be compliant and to hold.

  • Disputes between owners, trustees and the scheme
  • Disputes affecting whether levies can be recovered
  • Representation at CSOS conciliations
  • Settlement agreements and payment arrangements that can be enforced

Mediation alongside the CSOS

The Community Schemes Ombud Service starts every dispute with conciliation, and many disputes can be settled before an application is needed at all. We advise on which process suits the dispute, represent schemes at CSOS conciliations, and draft settlement agreements with clear terms and consequences for breach.

Frequently asked questions

Is a mediated agreement legally binding?

Yes, once it is signed by the parties it is a binding agreement. We draft settlement agreements with clear payment terms and consequences for breach, so the scheme can enforce them if needed.

Does mediation replace a CSOS application?

Not necessarily. Mediation can resolve a dispute before a CSOS application is needed, and the CSOS itself starts with conciliation. We advise on which process suits the dispute.
